Welcome to Photos by Jmacias. By accessing or using my website and photography services, you agree to be bound by the following Terms of Service. Please read them carefully before booking or making any inquiries.
1. Services
Photos by Jmacias provides professional photography services including, but not limited to, weddings, engagements, elopements, portraits, branding, and events. Services are subject to availability and may be scheduled through our online inquiry form or direct communication.
2. Booking & Payments
• All bookings require a signed photography agreement and a non-refundable retainer fee due at the time of contract signature to secure your date.
• The remaining balance (if applicable) must be paid according to the terms stated in your individual contract.
• Dates are not considered booked until both the signed contract and retainer fee are received.
3. Cancellation & Rescheduling
• Retainer fees are non-refundable under any circumstances.
• Clients may request to reschedule a session with reasonable notice. Rescheduling requests will be accommodated based on availability and at the discretion of Photos by Jmacias.
• Cancellations or no-shows result in forfeiture of the retainer fee.
4. Image Delivery
• Edited digital images are delivered through a private online gallery within the timeframe stated in your contract (typically [3–8 weeks] depending on session type).
• The number of final images and editing style are at the photographer’s artistic discretion.
5. Copyright & Usage Rights
• All photographs remain the copyrighted property of Photos by Jmacias.
• Clients receive personal-use rights to print, share, and post their images on social media or with family and friends.
• Commercial use, resale, or alteration of images without written consent from Photos by Jmacias is prohibited.
• Photos by Jmacias reserves the right to use any images for portfolio, marketing, and promotional purposes, unless otherwise agreed upon in writing.
6. Client Responsibilities
Clients agree to:
• Arrive on time and ready for their session or event.
• Provide accurate information regarding schedules, locations, and expectations.
• Obtain any necessary permissions for photography at chosen venues.
7. Liability
Photos by Jmacias is not liable for circumstances beyond control, including but not limited to weather, equipment failure, illness, or acts of God. In the rare event that the photographer cannot fulfill the session, all payments (excluding services already rendered) will be refunded.
8. Governing Law
These Terms of Service and any disputes arising from them are governed by the laws of the State of California, with jurisdiction in Los Angeles County.
9. Changes to Terms
Photos by Jmacias reserves the right to update or modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
